legitimate criticisms of the scheme would lead to my being compulsori-

-ly retired under it. And in this connection I have the honour to

point out with reference to paragraph 6 of the letter under reply

that if the action of the Secretary of State can bear the mild inter-

-pretation put upon it by Your Excellency there can be no reason for

the procedure which has been adopted for getting rid of me, and

inflicting serious pecuniary injury upon me.

In paragraph 8 of my letter under reply Your

Excellency refers to the "assurances". I have given in paragraph 8 of

my letter of 1st. December. I desire it to be understood that these assusrances are not made in view of the pressure of the moment.I

thought it advisable, though I regretted that it should be necessary

for me to do so, to point out that in assisting in putting the scheme into shape and at the time proposing to continue to do 80, had done what a public servant is expected to do if a scheme is introduced which he has already criticised; and in view of what has occurred I thought it advisableto point out not only that I should

continue to do so but that there was no reason to suppose that I

should follow any other line of conduct. My attitude towards the scheme is very clearly indicated in the last paragraph of my letter of 19th. September, 1909, in which I said "On the fact of it I fear that the scheme is unworkable, and for that reason it is of the utmost importance that the details should be submitted to Your Excellency for consideration before it is put into final shape. I rather gathered from the cable which Your Excellency has received, that the arrangement will be concluded in London and sent out here cut and dried. It would be a thousand pities if this were to happen, and I hope Your Excellency may think it expedient to cable to the Secretary of State suggesting that the details should be sent out be- -fore any scheme is finally settled.* From that attitude I have never departed.

I have further the honour to suggest, if the Law Society and the members of the Bar are not to be consulted by Your Excellency, that a Commissioner, who has had no connection with the Colony, be sent from home to enquire into the whole matter, or that
